ALS Surplus is a quote-only catalog of surplus airfield lighting equipment. Nothing on this site is sold online, and submitting a quote request does not create an order. Because our stock is surplus, availability shown here is an estimate and is confirmed only on the written quote we send you. We ship within the United States only, all sales are final, and any applicable sales tax is self-assessed by the purchaser.
These Terms and Conditions ("Terms") govern your use of the ALS Surplus website and your submission of quote requests through it. The site is operated by Airport Lighting Systems, Inc. ("ALS Surplus", "we", "us"). By using the site or submitting a quote request, you agree to these Terms.
We may update these Terms from time to time. The version in effect is the one published on this page at the time you submit a quote request.
This site is a catalog and quotation tool, not a store. No prices are displayed and nothing on this site can be purchased online. Submitting a quote request does not create an order, a contract, or any obligation on either party.
A binding agreement is formed only when we issue a written quote and you accept it, or when we accept a purchase order in writing. Product listings, specifications and stock indicators on this site are informational and are not an offer to sell.
ALS Surplus sells surplus and clearance stock. It moves quickly, it is not restocked, and quantities shown on this site come from our most recent inventory sync — which means a listing can remain up after the last unit is gone. Adding an item to your quote cart does not reserve it or place a hold on inventory. We confirm what we can actually supply when we send your written quote, and we will tell you promptly if something you requested is no longer available.
Because our inventory is surplus, quantities are finite and items are not replenished once sold. Where a listing shows a quantity or an "In Stock" indicator, that reflects our most recent inventory synchronization and should be treated as an estimate, not a commitment.
We are not liable for any loss arising from an item shown on the site being unavailable when you request it, including where you have relied on a listing in preparing a bid, schedule or procurement submission. If availability is critical to your project, contact us to confirm before you rely on it.
Quotes are provided in writing and are valid for the period stated on the quote. If no period is stated, quotes are valid for thirty (30) days from issue.
Prices quoted are exclusive of shipping, freight, insurance and applicable taxes unless the quote states otherwise. Quantities and item availability are confirmed on the quote and remain subject to prior sale until the quote is accepted and stock is allocated to your order.
We accept purchase orders from government agencies, airports, contractors and commercial buyers. Formal quotes on company letterhead are available for procurement and bid documentation on request. Where your purchase order contains terms that conflict with these Terms or with our quote, our quote governs unless we have agreed otherwise in writing.
Quoted amounts are exclusive of sales, use and similar transaction taxes. ALS Surplus does not assess, collect, report or remit sales or use tax, and will not do so on behalf of a purchaser, end user, airport authority or any similar party.
Where sales or use tax applies to a purchase, it is to be self-assessed by the purchaser and filed directly with the taxing authority for the ship-to address.
Any applicable sales or use tax, together with any penalty or interest arising from a failure to assess, file or remit it, is the sole responsibility of the purchaser.
Products offered through ALS Surplus are surplus or clearance stock sourced from certified manufacturers. Condition is stated on each product listing; most items are new and in original manufacturer packaging unless the listing says otherwise.
Product descriptions, part numbers, specifications and compatibility information are provided in good faith and are drawn from manufacturer data. You are responsible for confirming that a part meets the requirements of your installation, including any applicable FAA Advisory Circular, engineering specification or airport standard, before ordering.
References to manufacturers and their part numbers are for identification only and do not imply that ALS Surplus is an authorized distributor for, or affiliated with, those manufacturers.
All sales are final. ALS Surplus does not accept returns or exchanges and does not issue refunds. This applies in all cases, including change of mind, ordering error, project cancellation, duplicate ordering, or a part proving unsuitable for your installation.
Because sales are final, you are responsible for confirming that an item meets your requirements, including its compatibility with your equipment and installation, before you accept a quote.
Items are inspected and packed before dispatch. As set out in the shipping section below, title and risk of loss pass when the carrier takes possession, so where goods are damaged in transit the claim lies with the carrier. Notify us promptly and we will provide the documentation needed to support your carrier claim.
ALS Surplus ships within the United States only. We do not ship to addresses outside the United States.
We do not ship to PO Boxes. A physical street address capable of receiving freight or parcel delivery is required on every order.
Unless the quote states otherwise, items ship FOB origin. Title and risk of loss pass to you when the carrier takes possession. Shipping timeframes quoted are estimates and are not guaranteed.
Inspect all shipments on arrival. Note any visible damage on the carrier delivery receipt and notify us promptly so we can support a carrier claim.
Surplus items are sold as-is. Except as expressly stated in a written quote, ALS Surplus makes no warranties of any kind, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.
Where a manufacturer warranty remains in effect and is transferable, it passes to you; we will identify any such warranty on the quote. ALS Surplus does not extend or administer manufacturer warranties.
ALS Surplus resells surplus goods manufactured by third parties. We make no representation or warranty that any item is free from claims of patent, trademark, copyright, trade secret or other intellectual property infringement, and we give no indemnity against any such claim.
Any allegation that an item infringes a patent or other intellectual property right is a matter between you and the manufacturer of that item. You agree to direct any such claim, demand, proceeding or other legal action to the manufacturer of the item directly, and not to ALS Surplus.
To the fullest extent permitted by law, you release ALS Surplus from, and agree not to bring against ALS Surplus, any claim, demand or action arising from an assertion that goods we have supplied infringe the intellectual property rights of any person.
To the fullest extent permitted by law, ALS Surplus is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost business, project delay costs, or the cost of substitute goods, arising out of or relating to the site, a quote, or any goods supplied.
Our total liability for any claim relating to goods supplied will not exceed the amount you paid for the goods giving rise to the claim.
You agree not to use this site to submit false or fraudulent quote requests, to scrape or harvest catalog data by automated means, to interfere with the operation or security of the site, or to use it for any unlawful purpose.
Site content — including text, layout, graphics and product photography produced by us — is our property or is used with permission, and may not be reproduced for commercial use without our written consent.
When you submit a quote request we collect the contact and company details you provide, together with the items requested, in order to respond to your request and fulfil any resulting order.
ALS Surplus does not sell, rent or share your information with any third party or other person. What you give us is used to respond to you and to carry out your order, and for nothing else.
You may also opt in to occasional marketing email from ALS Surplus when you submit a quote. Opting in is entirely optional, is never required in order to receive a quote, and you can unsubscribe at any time using the link in any such email.
We retain quote and order records as required for our business and tax obligations. Our Privacy Policy sets out in full what we collect, how it is used and how long it is kept.
ALS Surplus sells and ships within the United States only. We do not export, and we do not accept orders for delivery outside the United States, including delivery to a freight forwarder, consolidator or similar intermediary for onward export.
If you export or re-export goods purchased from ALS Surplus after they have been delivered to you, you do so entirely on your own responsibility and are solely responsible for compliance with all applicable export control, sanctions, customs and regulatory requirements.
ALS Surplus accepts no liability arising from any export or re-export of goods it has supplied.
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law rules. The state and federal courts located in Texas will have exclusive jurisdiction over any dispute arising from these Terms.
